Calculating UAE end-of-service gratuity correctly requires walking through 7 specific decision points: tenure-length, salary base, contract type, termination reason, cap check, partial-year proration, and audit documentation. Skip any one and payroll finance may push back + the employee may dispute. This is the HR-manager-ready procedural walkthrough under Federal Law 33/2021.
Built around how MENA teams actually manage this day-to-day.
Must specify basic salary separately from allowances. Post-2022 UAE contracts are all fixed-term (limited). Document the start date + termination date precisely (day level) for partial-year proration.
UAE uses LAST basic salary (not average). Does NOT include housing allowance, transport, education, phone, utilities, or other allowances. Must be the final monthly basic as of termination date.
Hire date + termination date to the day. Deduct any unpaid-leave periods from tenure (paid leave counts). Transitions between related entities may count if no formal exit + re-hire.
Was it employer-initiated, employee-resigned, mutual consent, or Article 44 gross misconduct? Only misconduct eliminates EoS entirely. Post-2022 reform: resignation + termination pay the same amount for all other reasons.
If termination occurs during probation period (max 6 months per 33/2021), NO EoS is owed. Check contract probation clause. During probation, 14 days written notice required for termination.
Attendance records, approved leaves, salary-change history, any disciplinary warnings. MOHRE inspection may audit EoS calculations retroactively. Immutable payroll audit trail essential.
Tenure (years) = (termination_date - hire_date - unpaid_leave_days) / 365.25. Example: Hired 2020-03-15, terminated 2026-11-04 = 2425 days / 365.25 = 6.64 years of service. Day-precision matters for partial-year proration.
From our example 6.64 years: first 5 years = 5.0 years at 21-day rate; after year 5 = 1.64 years at 30-day rate. For employees under 5 years, entire tenure uses 21-day rate. For employees over 5, split required.
Days = (first_5_bucket × 21) + (after_5_bucket × 30). Example: (5 × 21) + (1.64 × 30) = 105 + 49.2 = 154.2 days.
Daily rate = last_basic_salary / 30 (standard UAE convention, not 365/12). Example: basic AED 15,000 / 30 = AED 500/day. Gratuity = 154.2 days × AED 500 = AED 77,100.
Cap = 2 × 12 × last_basic_salary = 24 × 15,000 = AED 360,000. Compare gratuity AED 77,100 vs cap AED 360,000 → under cap, no reduction. If calculated > cap, use cap amount instead.
If termination is under Article 44 (assault, drunken at work, theft, revealing secrets, falsifying documents, repeated absence without excuse, etc.), employee receives ZERO EoS. Must be properly documented with investigation + warnings. Otherwise, pay the Step 5 amount.
Final gratuity: AED 77,100. Document inputs, formula, final amount in employee file. Pay with final payslip within 14 days of termination per Federal Law 33/2021. MOHRE can audit retroactively — immutable records essential.
Follow the 7-step workflow: (1) calculate service years day-precisely, (2) split into first-5 + after-5, (3) apply 21/30-day formula for total days, (4) multiply by daily rate (basic/30), (5) check 2-year cap, (6) check Article 44 misconduct, (7) document + pay within 14 days. AttendUX automates all 7 steps — enter termination date and gratuity auto-calculates with audit trail.
BASIC salary only. UAE excludes housing allowance, transport allowance, education allowance, phone allowance, and other allowances from EoS base. This is the single most common error. Always document basic salary as a separate line item in contracts + payroll system to avoid dispute.
No, not since February 2022. Federal Law 33/2021 removed resignation reductions. Pre-2022, unlimited-contract employees who resigned had their gratuity reduced (1/3, 2/3, full based on tenure). Now, resigning and terminated employees receive the same calculation — only Article 44 gross misconduct eliminates EoS entirely.
Use the cap amount instead. 2-year cap = 2 × 12 × last_basic_salary. Example: basic AED 30,000 → cap AED 720,000. If uncapped formula gives AED 850,000 for a 30-year employee, pay only AED 720,000. This is a legal maximum regardless of tenure length.
Yes. Tenure calculated day-precision from hire + termination dates. Basic salary tracked separately from allowances. Formula auto-applies 21/30-day split. 2-year cap auto-checked. Article 44 flag available for HR to invoke when applicable. 14-day payment window flagged in payroll calendar. Immutable audit trail for MOHRE inspection. All 7 steps completed in seconds when employee is terminated.
